Article 1: Preamble

These general terms and conditions of sale are systematically brought to the attention of each buyer (hereinafter referred to as "the buyer"), whether an individual or a legal entity, to enable them to place an order on this website, to the exclusion of all other conditions.

Prior to placing an order, the purchaser declares that he/she has full legal capacity to enter into commitments under these general conditions of sale.

This site is available only to persons aged 18 or over.

Consequently, any access, use or order of one or more products on the www.cigarpassion.com site implies the full and unreserved consultation and acceptance by the purchaser of these general conditions of sale.

Article 3: Traceability and Warranty

CUBA WARRANTY SEAL / HABANOS / INDIVIDUAL BAR CODE / UNIQUE HABANOS IDENTIFICATION NUMBER, HOLOGRAM, AND SECRET CODE CONTAINED IN THE WARRANTY SEAL.

We strive every day to select and offer you the best quality cigars possible. We only buy from official importers accredited by the brands. For Cuban cigars (Habanos), the only official Swiss importer accredited by Habanos is Intertabak AG.

By sourcing Cuban cigars from this company, we offer you the certainty that the cigars you buy are 100% original and not counterfeit or grey market (lower quality cigars).

Each box of Cuban cigars purchased on our site has the following distinctive features:

The green Cuban "cellio", with a secret code hidden in the sticker, a bar code with a unique number identifying the box of cigars you've purchased, which can be identified directly on the official Habanos website, online! On the back of the box you'll find the importer's sticker Intertabak AG, the factory code and the production date. What's more, for many years now we've been investing in ultra-high-performance means of preserving our stock in order to offer our customers top-premium quality - probably the best in Switzerland!

Our primary objective is the rigorous selection of the cigars we buy from our suppliers. That's why we only work with official and sole importers who are bound by contract to the brands they represent for import into Switzerland. This guarantees and certifies the quality and traceability of the cigars you buy from us.

We are part of a Swiss family group, active in the sale of cigars and other tobacco products for over 40 years.

Each box is checked by our specialists before each order is validated. The boxes are hermetically packed to ensure that the cigars retain their optimum humidity during shipment.

Please do not keep them vacuum-packed after receipt.

 

Article 4: Prices

The prices of our products are indicated in Swiss Francs (CHF) concerning the prices in Euros (€), they are for information only and do not include shipping and handling from our Swiss warehouse.

The sale prices of products may be modified by Cigarpassion at any time, it being understood that the prices invoiced are those in force on the date of the order.

Order processing and shipping costs are extra.

 

Article 5: Customs duties for countries outside Switzerland or Europe.

Certain taxes or customs duties may be due when the parcel reaches its destination. These are the sole responsibility of the Buyer. Cigarpassion is not obliged to inform the Buyer of any customs duties or other applicable taxes.

 

Article 6: The order and validation of the transaction.

A minimum amount of 200.00 CHF is required to validate your order.

It is important to specify your telephone number, address and e-mail address when placing an order. By confirming your order, you declare that you accept the order and these terms and conditions in full and without reservation.

Your order will then be forwarded to our customer service department for processing.

We reserve the right to refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.

As soon as your order has been registered, a detailed acknowledgement of receipt will be sent to your e-mail address. This acknowledgement will confirm the exact amount invoiced and the delivery terms of your order.

Order cancellation: For all order cancellations, a handling fee of at least 50.00 CHF will be charged per refund. From 500.00 CHF, the handling fee is 10% of the order amount.

 

Article 7: Product availability

cigarpassion.com makes every effort to ensure product availability.

If, despite careful monitoring, the products initially indicated as being in stock prove to be unavailable after the order has been placed, cigarpassion.com will inform the purchaser by e-mail as soon as possible.

We guarantee the quality of our products, our customer service and our prices. Under no circumstances are we responsible for the non-delivery of our cigars by our importer. (Delay in delivery due to the importer).

cigarpassion.com may at any time replace a product ordered by the customer with an equivalent product in terms of value and quantity. For example: 1 box of 25 cigars can be replaced by a carton of 5 boxes of 5 cigars. If the product is identical, our company may replace it with the same product, but in a different packaging, without notifying the customer.

These conditions are valid when the situation in the country of dispatch and receipt as well as the international geopolitical situation are stable. In all other cases, our company cannot be held liable for the above deadlines.

Please note that the lead time is based on information provided to us by our suppliers. Unfortunately, it often happens that the suppliers themselves are unable to meet their deadlines and delay delivery.

If we receive the products earlier than expected, we will send them to you as soon as possible.

 

Article 8: Accepted methods of payment

The buyer must pay by credit card or bank transfer.

The card is debited on the day the order is placed, and is considered effective once the bank processing centers have confirmed the agreement.

The buyer guarantees that he/she has the necessary authorizations to use the method of payment chosen when registering his/her order form.

cigarpassion.com reserves the right to suspend or cancel any order and/or delivery in the event of non-payment of any sum due by the buyer, in the event of a payment incident or in the event of fraud or attempted fraud relating to the use of the cigarpassion.com website.

As part of the fight against Internet fraud, information relating to the buyer's order may be transmitted to any third party for verification.

Article 8.1: Secure payment

Payment is made by the method authorized on the cigarpassion.com website.

Online payment by credit card is entirely secure. The entire transaction is encrypted and sent to an SSL (Secure Socket Layer) bank validation server. You can therefore make your purchases in complete security.

Article 9: Shipping and handling

Article 9.1 General rule

Delivery is made to the address indicated by the purchaser at the time of ordering. It is the purchaser's responsibility to provide all details necessary for the correct delivery of the parcel. The transfer of risks on the products sold by our company takes place when the products are handed over by our company to the carrier.

Depending on the choice of payment provider, delivery will be made exclusively in Switzerland and will be handled by a third-party service provider domiciled in Switzerland. This company will contact you to take charge of your order.

The buyer is obliged to check the condition of the packaging and the contents of the goods on delivery. If the purchaser's parcel has been delivered directly to the mailbox and is damaged, the purchaser must go to the post office to report the damage to the parcel. If this is not done on the day of delivery, the post office may refuse to pay compensation.

Article 9.2 Shipping times

Please refer to article 7 for Swiss and European destinations
For international destinations: 15 to 20 working days (this time includes customs control).
These times are estimates: any overrun in terms of lead times may not give rise to damages or to the withholding or cancellation of the order by the purchaser.

cigarpassion.com cannot be held responsible for the delivery obligation in all cases of force majeure (strikes, floods, fire, etc. without this list being limitative).

Unconditional acceptance of the products ordered by the customer covers any apparent defect and/or shortage. Complaints made by the purchaser under the terms and conditions described in this article do not suspend payment by the customer for the goods concerned. Under no circumstances can our company be held liable for destruction, damage, loss or theft during transport, even if it has chosen the carrier.

Article 9.3 Routing

Delivery is made by the deliveryman to the address indicated by the purchaser on the order form. An acknowledgement of receipt must be signed by the purchaser. In the event of absence, the purchaser will receive a notice of passage from the deliveryman, and can request delivery of the parcel the following day via the Internet.

Depending on the choice of payment provider, delivery will only be made in Switzerland and will be handled by a third-party service provider domiciled in Switzerland. This company will contact you to take charge of your order.

If the customer does not claim the parcel from the carrier within the allotted time, and returns the parcel to cigarpassion.com, the customer will have the option of having the parcel resent by paying the shipping costs again, regardless of the initial amount of shipping costs paid, as well as administrative fees.

In the event of a parcel being returned by the Post Office for the reason "Does not live at the address indicated", and subject to receipt of the products in perfect condition, cigarpassion.com will reship the parcel at the purchaser's expense.

In the event of the return of a parcel in which the items dispatched comply with the customer's order, the customer will be responsible for all costs incurred in re-routing the order until it is received by cigarpassion.com. All rerouting costs include, in particular, transport costs, customs clearance costs and administrative costs. In the event of cigarpassion.com advancing the payment of transport costs or customs duties, the amount advanced will be deducted from the value of the goods.

Article 9.4 Complaints

In the event of a claim, several elements must be provided:

When you receive your parcel, it is imperative that you carry out the following operations in the chronological order described below.

  1. On delivery-receipt of the parcel, photograph the parcel still sealed (completely closed).
  1. Photograph the points of greatest impact on the delivered package, as well as the documents accompanying the package.
  1. Open the package and photograph the goods inside without handling them.
  1. Take the goods out of the parcel and photograph: all six sides of the box (product), WITHOUT OPENING THE PLASTIC FILM SURROUNDING THE VACUUM-PACKED PRODUCT IT IS IMPERATIVE TO RESPECT THIS POINT, Our standards of quality control and cigar protection are among the highest on the market. This guarantees that all cigars are intact and in perfect condition when they leave the warehouse.
  1. Photograph any parts affected by impacts. The photos must clearly show the defects.
  2. Do not open the hermetically sealed cigar bag (plastic vacuum bag).
  3. Describe any damage to products in detail.
  4. Send photos of products requesting complaint with order number and delivery date.
  5. The time limit for validating your claim is 24 hours after receipt of your order. After this time, your claim will not be processed and will be considered as validated by the customer.

 

Article 10: Warranty

The seller guarantees that the goods are manufactured, inspected and packaged without material defects. Products must be inspected by the customer on delivery, and any reservations or claims relating to shortages or apparent defects must be made within 48 hours of receipt of the order. Please include photos of the outside of the package and a video of the contents after opening.

In the event of apparent defects, we will replace the defective parts, subject to verification of the alleged defects.

Defects and deterioration of the products delivered as a result of abnormal storage and/or conservation conditions at the customer's premises, particularly in the event of an accident of any kind whatsoever, shall not entitle the customer to any warranty owed by our company, e.g. storage near a heat source without hydrometry, outside the established standards.

cigarpassion.com declines all responsibility for the resale of products outside Switzerland.

The products offered comply with Swiss legislation. cigarpassion .com shall not be held liable in the event of non-compliance with the legislation of the country where the products are delivered. It is the buyer's responsibility to check with local authorities regarding the possibility of importing or using the products or services he/she intends to order.

 

Article 11: Intellectual property

In accordance with the laws governing the ownership of literary and artistic rights or other similar rights, the cigarpassion.com website and all the elements, trademarks, designs, models, logos, graphics, etc. found on the said site, as well as their compilation, are the exclusive property of cigarpassion.com or its suppliers, the latter granting no license, nor any right other than that of consulting the site.

The reproduction or use of all or part of these elements is authorized solely for the purposes of information for personal and private use, any reproduction and any use of copies made for other purposes being expressly prohibited. Any other use constitutes an infringement and is punishable under intellectual property law, unless prior written authorization has been obtained from cigarpassion.com.

All technical documents provided to our customers remain the exclusive property of www.cigarpassion.com, the sole owner of the intellectual property rights on these documents, and must be returned to them on request.

Our customers undertake not to make any use of these documents which might infringe our company's industrial or intellectual property rights, and undertake not to disclose them to any third party.

 

Article 12: Disclaimer

Goods sold on the cigarpassion.com website are subject to INCOTERM: EXW.

La Couronne S.A. is responsible for delivery of the customer's order only until it has been picked up in our warehouse by the logistics service provider (La Poste, FEDEX, DHL, etc....).

Specifically, when the customer places an order on our site, he or she has no right to claim for loss, theft, destruction, partial or total damage, incorrect or delayed delivery, potential customs seizure, or any other case meeting these criteria.

This being the case, the customer is not in a position to activate any request for reimbursement from the debtor of the credit card used for his purchase on our online shop (charge-back), in all cases linked to the delivery service. When purchasing on our website, the customer accepts all risks involved in the transport and delivery of the order. It is therefore the customer's responsibility to take all necessary steps with the logistics company (delivery) in order to settle any dispute. La Couronne SA will do everything in its power to assist the customer in this process.

cigarpassion.com is published by La Couronne S.A., and is provided "as is". cigarpassion .com cannot be held liable for any direct, indirect or consequential damage arising from the use of this site.

 

Article 13: Reservations

cigarpassion.com reserves the right to modify the site and the conditions of sale at any time. In the event of contradiction between versions of a contract or conditions of sale translated into different languages, the French version shall prevail.

 

Article 14: Legal information

This contract is subject to Swiss law. The language of this contract is French. In the event of a dispute, the Swiss courts shall have sole jurisdiction, with its place of jurisdiction based in Nyon.
